Abstract

RÉSUMÉ
Introduction. L’objectif de notre étude était d’apprécier l’influence de la crainte de la poursuite judiciaire sur la pratique médicale des médecins du CHU de Bouaké. Matériel et méthodes. Il s’agissait d’une étude transversale prospective à visée descriptive et analytique réalisée auprès de 227 médecins exerçant au CHU de Bouaké sur une période de deux mois (du 15 Juillet au 15 Septembre 2022) dans différents services du CHU de Bouaké. Résultats. Les médecins enquêtés appartenaient à la tranche d’âge de 25 à 35 ans (n= 134 ; 57,4 %), de sexe masculin (n= 169 ; 74,4 %), avec un âge moyen de 35,1 ans et exerçant en majorité dans une spécialité médicale (n= 124 ; 54,6 %), avec une ancienneté d’exercice comprise entre 1 et 5 ans (68,3 %). Pour nos enquêtés, la chirurgie était la spécialité la plus exposée aux risques judiciaires (48 %). Aucune différence n’a été observée entre les personnes ayant répondu « Oui » ou « Non » à l’influence de la crainte de la poursuite judiciaire sur la prescription des examens complémentaires, la prescription médicamenteuse et de l’intervention chirurgicale, la transmission de l’information médicale, la demande d’un avis spécialisé ainsi que la proposition de vente de médicaments aux patients. Il existait par contre une différence entre les personnes ayant répondu « Oui » ou « Non » pour la proposition de vente de matériel chirurgical aux patients (p-value=0,041). Conclusion. Le médecin n’intègre pas les aspects juridiques dans la recherche du mieux-être chez son patient.


ABSTRACT
Introduction. The aim of our study was to assess the influence of the fear of prosecution on the medical practice of physicians at Bouaké University Hospital. Material and methods. This was a prospective cross-sectional study descriptive and analytical study of 227 doctors practicing at the Bouaké CHU de Bouaké over a two-month period (from July 15 to September 15, 2022) in various departments of the CHU de Bouaké. Results. The physicians surveyed were mostly in the 25 to 35 age group (n=134; 57.4%), male (n= 169; 74.4%), with an average age of 35.1 years. They belonged to a medical specialty (n= 124; 54.6%), with a length of service of between 1 and 5 years (68.3%). For our respondents, surgery was the specialty most exposed to legal risks (48%). No difference was observed between those who answered “Yes” or “No ” to the influence of fear of legal proceedings on the prescription of paraclinical examinations, medications and surgery and surgical intervention, transmission of medical information, request for specialist seeking specialist advice and offering to sell medicines to patients. There was a difference between those who answered “Yes” and those who answered or “No” for the proposal to sell surgical material to patients (p-value=0.041). Conclusion. The physician in Bouake does not integrate legal aspects in his patient's quest for well-being.
